Defendant, Brian F. LaBarre, was found guilty by a jury of two counts of unlawful possession of narcotics, namely, cocaine and hashish, and one count of unlawful possession of a prohibited drug, d-lysergic acid diethylamide (LSD), in violation of Minn. St. cc. 618 and 152, respectively. On this appeal from the judgment of conviction and from the denial of a motion for a new trial, defendant principally challenges the constitutional validity of a search warrant, the execution of which resulted in the seizure of incriminating evidence including a large quantity of drugs. He also claims that the evidence was insufficient to sustain the jurys verdict. We find no constitutional defect in the issuance of the search warrant and ample evidence to sustain defendants conviction on all counts.
